The QCAA encourages the distribution and use of QCAA (and its predecessors’) publications, data, QCAA brand content (e.g. myQCE), and related materials, which are collectively referred to in this notice as ‘QCAA information’. The QCAA also supports the creation and use of open educational resources (OER).

Creative Commons licensing

Subject to the exceptions listed below, QCAA information is provided under a Creative Commons Attribution 4.0 Licence (CC BY 4.0).

Exceptions

The Creative Commons Attribution 4.0 Licence does not apply to the following material, unless otherwise indicated:

• the Queensland Government coat of arms and the QCAA and QSA trademarks, which may not be reproduced without permission
• third-party content, which is used by the QCAA under various terms (see below for further information on QCAA use of third-party content)
• any information that carries an alternative copyright notice expressly excluding it from the Creative Commons Attribution 4.0 Licence
• stand-alone images of students, which may not be reproduced without permission
• QCAA developed video and audio containing students, which are licensed under the Creative Commons Attribution-NoDerivatives 4.0 Licence (CC BY-ND 4.0)
• student work samples, which are the copyright of the student or their school and may not be reproduced without permission (student samples may include video or audio recordings created or captured as part of assessment).

Reproduction of QCAA information that contains images of students or samples of student work is permitted provided that the images or samples are not separated from the rest of the QCAA information.

Attribution

Use of QCAA information should be attributed (in accordance with the CC licences the QCAA uses) in one of the formats shown below.

• As a minimum, the following attribution should be used with ‘QCAA’ linked to this copyright notice. For example:

  © State of Queensland (QCAA) 2023

• Where possible, accompany the attribution with a link back to the material obtained from the QCAA website. This contextualises information and assists people looking for the current version of the material in the future. For example:

• If you have modified QCAA information, preface the attribution with the words ‘Modified from’. For example:

Under the terms of the licence, you cannot, as part your attribution, imply that the QCAA supports or is affiliated with your use of QCAA information. Where possible, remove the Queensland Government coat of arms and QCAA or QSA trademarks. Neither the coat of arms nor the QCAA or QSA trademarks may be reproduced separately or in adapted material without permission.

Third-party content

The QCAA prefers to incorporate Creative Commons licensed or public domain material into QCAA information. This supports the QCAA’s policy of implementing OER. However, the QCAA also maintains direct licences with some rights holders.

The QCAA cannot license third-party content to you, as any third-party content used in QCAA information remains the third party’s property. As far as practicable, where third-party content has been used in QCAA information it will be clearly identified with licensing information included as part of the attribution.

Where the rights holder has not adopted a Creative Commons or similar licence, you should contact them directly for permission to reuse their content.

Australian Curriculum, Assessment and Reporting Authority (ACARA)

The QCAA reproduces certain material from the Australian Curriculum. Material that is licensed by ACARA under a Creative Commons Attribution 4.0 Licence (CC BY 4.0) is attributed as follows:

QCAA social media channels

The QCAA uses social media channels for communicating with the public and maintains a presence on Facebook, Instagram, LinkedIn, X and through its YouTube channels (QCAA and QSA).

Subject to the terms of use of these services and the QCAA copyright notice, and except where otherwise stated, you may use QCAA information on these channels under a Creative Commons Attribution 4.0 Licence (CC BY 4.0).

To avoid doubt, videos depicting students are licensed under the Creative Commons Attribution-NoDerivatives 4.0 Licence (CC BY-ND 4.0), e.g.

No circumvention of terms

You must check and comply with the licensing information for each piece of material that you wish to use. You may also use any material in accordance with rights you may have under the copyright law, e.g. under the fair dealing provisions or statutory licences in the Copyright Act 1968 (Cth).

Using material in a way not permitted by this copyright notice may infringe copyright. Infringing copyright may expose you to legal action by, and liability to, the copyright owner.
